Terms of Use

Last updated 24 August 2026

The terms below cover your use of this website: what you can do with what we publish, how to read the client results we show, and where our responsibilities start and stop.

About these terms

These terms of use govern your use of toucanecommerce.com (the “site”). The site is operated by Trade Toucan Limited, trading as Toucan Ecommerce (“Toucan”, “we”, “us”), a specialist Amazon and TikTok Shop agency registered in England and Wales under company number 11237628, with its registered office at 30 Colleton Drive, Twyford, Reading, England, RG10 0AX.

Our global head office is at Ariel Way, London W12 7GF, with further offices in Miami, Mexico City, Toronto and Melbourne.

By using the site you accept these terms. If you do not accept them, please stop using the site.

Changes to these terms

We update these terms from time to time — when we add a new part of the site, change how something works, or when the law moves. The version published here is the one that applies, and the date above tells you when it last changed. Please check back if you use the site regularly.

Using the site

You are welcome to read, print and share our pages, and to download our whitepapers, for your own or your organisation’s internal use.

You must not:

  • use the site for any unlawful or fraudulent purpose, or in any way that breaches these terms;
  • copy, republish or resell our content commercially, or present it as your own work;
  • scrape, harvest or systematically extract content from the site without our written permission;
  • use our content to train a machine learning or generative AI model without our written permission;
  • introduce viruses or other malicious code, or try to gain unauthorised access to the site, the server it runs on, or any connected system;
  • attack the site by denial-of-service or any similar means.

We may withdraw access to the site, or to any part of it, from anyone who breaches these terms.

Our content and intellectual property

Everything on the site — the copy, page designs, photography, illustration, video, whitepapers, charts, and the Toucan name and logo — belongs to Toucan or to the people who licensed it to us, and is protected by copyright and trade mark law. Using the site does not transfer any of those rights to you.

If you want to quote us, please credit Toucan and link to the page you took it from. For anything more than a short quote, ask us first.

Client results and performance figures

Our case studies, charts and headline figures describe results achieved for a named brand, in a specific category, over a specific period. They are reported in good faith from the platform and client data we held at the time.

They are not a forecast, a promise or a guarantee of what any other account will achieve. Amazon and TikTok Shop performance depends on your products, pricing, margin, stock position, competitors and the platforms’ own changes — most of which sit outside any agency’s control.

Where a client’s figures appear anonymously, or a metric is indexed rather than absolute, that is because we are bound by confidentiality — not because the result is unrepresentative.

Information, not advice

Our insights, whitepapers, webinars and event write-ups are general information about selling on Amazon, TikTok Shop and other marketplaces. They are not professional advice for your situation, and they are not legal, tax, accounting or financial advice.

Please don’t make a commercial decision on the strength of a page on this site alone. If you want a view on your own account, talk to us and we’ll look at your actual data.

Whitepapers, webinars and events

Some of our content asks for your name, email and company before you download it or register for it. We use those details to send you what you asked for and, where you have agreed to it, to stay in touch about our work. How we handle your personal information is set out in our privacy policy.

Whitepapers and recordings reflect the market at the time they were produced. Marketplace mechanics move quickly, so an older paper may describe fees, features or ad formats that have since changed.

Enquiries and our services

Sending us a form or an email starts a conversation. It does not create a contract, and nothing on the site is an offer to provide services at a particular scope or price.

If we go on to work together, that work is governed by the separate agreement we sign with you. Where that agreement and these terms disagree about our services, the signed agreement wins.

Third-party names, marks and links

Amazon, TikTok Shop and the other platforms, tools and brands named on this site are the trade marks of their respective owners. We name them to describe the work we do.

Where we hold a formal partner status — such as Amazon Ads Advanced Partner or TikTok Shop Partner — we say so and it is accurate. Beyond that we are an independent agency: we are not owned by, acting for, or speaking on behalf of any platform, and nothing published here is endorsed by them.

The site links out to other websites. We don’t control those sites and we’re not responsible for their content or their privacy practices.

Availability of the site

We work to keep the site up and accurate, but we don’t guarantee that it will always be available, uninterrupted or error-free, and we may change, suspend or withdraw any part of it without notice.

The site is provided as it stands. We give no warranty, express or implied, that its content is complete or current.

Our liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

Subject to that, we are not liable for any loss of profit, revenue, business or anticipated savings, for loss of or damage to data, or for any indirect or consequential loss, arising from your use of the site or from reliance on anything published on it.

If you use the site as a consumer rather than for business, these limits do not affect your statutory rights.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute about them or about the site. If you are a consumer resident elsewhere in the UK, you may also bring proceedings in your local courts.
